The CFS-294 is the form used by the licensing specialist to enumerate and document violations of administrative rules observed in a licensed facility. Less often, it may also be used to enumerate and document a violation self-reported by the licensee.
The CFS-294 must provide a clear statement of how the center is out of compliance with each identified rule. Only administrative rule violations are cited on the CFS-294. If the licensing specialist determines that the licensee is not complying with statutory requirements, the licensing specialist does not cite the statute, but rather, cites the appropriate administrative rule requirement that compels the licensee to comply with all laws governing the facility and its operations (e.g., Compliance with All Laws). In the licensing specialist’s description of the violation, s/he references the specific statutory codes.
The violations observed and documented by the licensing specialist are identified and described in the first two columns of the CFS-294. The licensing specialist’s description of a violation in the External Comments field of the mobile app is automatically entered in the CFS-294, in the column labeled Rule/Statute Number - Noncompliance Statement.
When the WISCCRS-generated CFS-294 is issued to a licensed provider, the licensing specialist identifies the date when the licensee must return the form with a correction plan for each cited violation. S/he provides the form to the center either through the mail, email, or hand delivery within 10 business days of the site visit (or receipt of the self-report). The licensee must post a copy of the CFS-294 near the license.
In responding to a CFS-294, the licensee outlines how each violation cited on the CFS-294 will be corrected in the Correction Plan column and identifies the date by which each correction will be completed in the Expected Completion Date column. The licensee signs and returns the CFS-294 to BECR by the specified due date, usually within 14 calendar days from the date it is issued. The licensing specialist reviews and approves the correction plan and the expected completion dates, and refers to the CFS-294 with the correction plan during subsequent monitoring visits.
The licensee replaces the original posting of CFS-294 with the updated version of the CFS-294 that indicates the corrective actions the licensee will take. The updated CFS-294 with the licensee’s correction plan must remain posted at the center until the licensing specialist verifies correction of each violation. Verification is notated by the licensing specialist in the Verification Date column.
The CFS-294 results are entered into WISCCRS as soon as possible after the monitoring visit or self-report. The mobile app uploads all visit data directly into WISCCRS and the results are posted to the public search website one day after the licensing specialist enters the issue date for the visit. The updated CFS-294 containing the licensee’s correction plan is posted to the public search website as soon as it is approved by the licensing specialist and scanned into WISCCRS.
