Child Care Licensing Procedure Manual
Wis. Admin Code §§ 250.04(2)(L), 250.04(2)(m), 250.05(2)(b), 251.04(2)(n), 251.04(2)(o), 251.05(2)(a) and 252.41(1)(n) and 252.41(1)(o) requires child care and day camp licensees to submit all background check request forms for employees and household members, and to receive preliminary and final eligibility results according to the rule provisions.
Licensing specialists must review information in the Child Care Provider Portal and/or the provider’s files to ensure that all background check request forms have been submitted and that background check results have been obtained by licensees, including the required preliminary and final eligibility determinations.
The licensing specialist should look for verification that the final eligibility notice from the CBU has been issued. The final eligibility determination will be identified in the Child Care Provider Portal or the final eligibility notice may be printed and filed in the center file or uploaded in the provider’s electronic record files. If the background check has not been completed and the final eligibility notice has not yet been issued, the licensing specialist should look for verification that the preliminary eligibility notice has been issued. This verification may be a designation of “Preliminary” in the Child Care Provider Portal or the preliminary eligibility notice may be printed and filed in the center file or uploaded in the provider’s electronic record file.
When a center is found to be out of compliance with these background check requirements, the licensing specialist should issue a CFS-294 identifying the applicable rule violation. If necessary, if the licensee does not correct the violation, a warning letter or an enforcement action may be issued.
