Child Care Background Check Procedures
Individuals who have committed an offense on the Barred Offenses Table listed under the “bar with rehabilitation” category, are barred from regulatory approval, employment as a caregiver or household member residency until they receive approval through the rehabilitation review process in accordance with Wis. Stat. § 48.686 and Wis. Admin. Code § DCF 13. Only those offenses with a “bar with rehabilitation” designation are eligible for rehabilitation review. If the offense does not have a designation of “rehabilitation review,” the individual is not eligible for rehabilitation review.
Rehabilitation review approval allows the bar to be lifted when individuals demonstrate by “clear and convincing evidence” that they have been rehabilitated in accordance with the provisions established by Wis. Stat. § 48.686 and Wis. Admin. Code § DCF 13. Approval only applies to the offenses known and considered at the time the requestor seeks review. If the requestor subsequently commits additional offenses, the new offense may create a new bar.
