Child Care Background Check Procedures
Any person who has received rehabilitation review approval is considered eligible to be certified, licensed, employed at or reside as a household member in the specific program areas indicated for approval by the rehabilitation review panel. Approval does not guarantee anything beyond the right to be considered as any other person who is not barred.
A person must submit a request for redetermination of their background check eligibility and provide proof of the rehabilitation review approval. A person with approval may still have their regulatory approval denied or revoked or not be hired as an employee of a child care center. However, the particular offenses that caused the bar and were considered when the rehabilitation review approval was granted cannot be used as the basis for denial, revocation or an ineligibility determination by the CBU. Also, it cannot be the basis for determining a substantial relationship. However, should a person with conditional approval fail to meet any of the terms of that approval, the bar may still be applicable and the basis of a denial or revocation.
