7.3.4 Approval, Denial, Deferral

The panel may approve the rehabilitation review in whole, with limitations, or with or without conditions. As a rule, most panels issue a “no repeat” condition. If the panel finds sufficient evidence of rehabilitation, the panel will approve the application and may specify conditions or limitations that apply to the approval. Rehabilitation review approval does not ensure requestors will be hired, receive permission to reside or be granted regulatory approval. For example, a person may request approval to apply for a license as a family child care provider and certification as a child care operator and to seek employment in a group child care facility. The panel may limit its approval by lifting the bar for potential employment in a group child care facility because it believes there will be adequate supervision in that setting, but not approve lifting the bar for family child care licensure or certification. The panel may also establish conditions on its approval. For example, a condition may be that the requestor continues to attend an alcohol and drug treatment program, obtains anger management counseling, or does not repeat the offense.

If the panel does not find clear and convincing evidence of rehabilitation, the denial decision will provide the reasons for the denial and inform the requestor of his or her rights to file an appeal within 10 days of the decision. The applicant may not reapply for rehabilitation review for the same or a similar reason for one year from the date of the denial, even when the denial was for failure to submit all of the application documentation.

The panel may defer a final decision for up to six (6) months to gather additional information or for other reasons. For example, a decision may be deferred for up to six (6) months for the requestor to complete required training or counseling. While the decision is deferred, the requestor continues to be barred.
