9 - Noncompliance Statement

A Noncompliance Statement and Correction Plan (DCF-F-CFS0294), often referred to as a ‘294’, is used by certification workers to enumerate, document and communicate to the operator statute and / or administrative rule violations.

 

Certification workers issue a Noncompliance Statement and enter violations in WISCCRS when a violation is observed through:

 

 

The location (premises / site) where the care will be provided, must be inspected and found to comply with DCF 202 before an initial or relocation certificate may be granted. Although a certification worker may enter Monitoring Results in WISCCRS for a new/relocation visit, they should not record violations in WISCCRS and should not issue a noncompliance (or compliance statement) for new or relocation site visits. Instead, the certifier will use the Standards and Checklist to document which rule(s) the operator / premise is not in compliance with or issue the certificate if the operator is in compliance.

 

Some certification agencies use, in addition to the Standards and Checklist, the Exit Interview or the Site Visit Comments / Recommendations form to summarize necessary corrections before the certification will be granted. Use of the Exit Interview or the Site Visits Comments / Recommendation form (templates) is not mandatory. See Section 19 regarding Exit Interview. The department has posted optional (294 cover letter and instructions templates) on the Certification SharePoint site that a certification worker may choose to include with the Noncompliance Statement. Use of these templates is optional. The template may be modified for certification agency use.

The certified operator is not required to post the Noncompliance Statement.
