On occasion, a certification worker may mistakenly suspend a certified operator for violations of DCF 202 in lieu of or instead of issuing a noncompliance statement and then re-instate the operator when s/he has come back into compliance. It is important the certifier establish compliance history in WISCCRS. Information regarding the operator’s noncompliance history is available on the public search website; therefore, it is important certifiers are issuing noncompliance statements (294s) and compliance statements in a consistent and fair manner across the state.
It may be appropriate, depending on the severity of the violations, to issue the 294 and suspend the certification at the same time (citing the basis for the suspension in the sanction letter), and then reinstate the operator when they come into compliance. However, an operator should not be suspended in lieu of issuing the 294. This includes violations related to the background check law, such as failure to return a BCR for a new resident. If a certification worker suspends the certification because the operator has not submitted the required BCR form for a new household member, for example, they should also issue the 294.
