Child Care Background Check Procedures
Since January 2015, Child Protective Service (CPS) agencies are required to provide an individual who has an initial determination of substantiated child maltreatment with an opportunity for an agency review of the decision prior to establishing a final determination of substantiated child maltreatment. Once a final determination has been made, the CPS agency is required to notify the individual in writing of the decision and provide the individual with information regarding rights to a contested case hearing. A final determination can only be made if the person does not request an agency review within 15 days after the date of notice of initial substantiation determination.
A person might not realize that he or she has been involved in a child abuse or neglect investigation conducted by CPS prior to 1999 or has been identified in a substantiated finding as a maltreater. CPS may not have provided due process to the persons against whom findings were made and frequently did not advise them of the substantiated findings. Note that individuals might fail to disclose this information in Section B of the Background Check Request form without intending to withhold the truth.
