5.6.4 When a Household Member Fails to Disclose a Substantiated CAN Finding

When a household member in a facility that is licensed or applying for licensure fails to reveal a substantiated child abuse and neglect finding on the Background Check Request form, the CBU, in consultation with the BECR regional office prepares the Notice of Denial or Notice of Revocation for failure to disclose the information. Unless appealed, the denial or revocation is effective immediately upon notice. BECR is required by Wis. Stat. § 48.715 to provide written notice of the grounds for the enforcement action and an explanation of the process for appealing the action. Any person aggrieved by the action taken under Wis. Stat. §§ 48.715, 48.68(1) and/or 48.686 has the right to a hearing under Wis. Stat. § 227.42.

Certification agencies have authority to deny, revoke, or suspend for any of the reasons specified under Wis. Admin. Code § DCF 202.06. The certification agency is required to provide written notice of the grounds for the enforcement action and an explanation of the process for appealing the action. The action may be appealed under Wis. Stat. § 227 for Milwuakee certification, and under Chapter 68 for the balance of state.
