Child Care Background Check Procedures
If an individual is identified as a maltreater in a final determination of substantiated abuse or neglect, the individual will receive an ineligibility determination from the CBU. If a licensee or operator or household member is identified as a maltreater in a final determination of substantiated child abuse or neglect finding, the BECR regional office or the certification agency must proceed with denial or revocation of the license or certification, even when the individual is appealing the child abuse or neglect final determination. The provisions of the background check law mandate denial or revocation when a barred offense exists until it is lifted through rehabilitation review approval. The licensee or certified operator or household member is barred until the outcome of the child abuse or neglect final determination, the child abuse or neglect finding has been reversed, or the individual has completed a rehabilitation review.
If an applicant or household member is appealing a final determination or substantiated child abuse or neglect, the BECR regional office or certification agency may:
Hold the application pending the outcome of the appeal, or
Recommend to the applicant that he or she withdraw the application pending the outcome of the appeal, or
Immediately deny the application.
If the child abuse and neglect final determination is reversed to unsubstantiated, the individual may submit a new application for licensure or certification.
