Child Care Background Check Procedures
Under the background check law, a pending CPS investigation can be used to bar a person or to determine substantial relationship. However, an ongoing CPS investigation may be the basis for issuing a summary suspension to close the licensed facility or initiate a voluntary temporary closure. The certification agency may issue an enforcement using Wis. Admin. Code ยง DCF 202 as the basis.
When a licensee or certified operator agrees to a voluntary temporary closure pending the outcome of the CPS investigation, the licensee or operator waives his or her appeal rights and agrees to remain closed until the investigation ends. If the licensee refuses to voluntarily close, BECR must summarily suspend the license. If a certified operator refuses to voluntarily close, the certification agency may take enforcement action. Appeal rights related to the closure may only be exercised if enforcement action is taken on license or certification. BECR regional licensing staff or the certification agency draft the temporary closure agreement that outlines the conditions under which a licensee or operator remains closed.
