Child Care Licensing Procedure Manual
A revocation is the closure of a facility by BECR through withdrawal of a probationary or continuing license to operate.
There are numerous reasons for initiating revocation of a license. For example, during a routine monitoring visit or complaint investigation, the licensing specialist may discover several repeat serious violations that threaten the safety of children in care. Or, a county child protective service worker may inform the licensing specialist that s/he is about to substantiate an allegation of child abuse or neglect at the center. The criminal background of a new household member may be discovered during a background check. In all cases, it is critical for the licensing specialist to determine the known facts of the situation that may require license revocation as soon as s/he is alerted. In some instances, this may require the licensing specialist to conduct a complaint investigation. When serious statutory and/or rule violations signal that a license revocation may be necessary, the licensing specialist must immediately report the situation to the licensing manager/licensing supervisor. If the licensing manager/licensing supervisor is unavailable, the specialist must report the situation to another regional licensing manager or the bureau director and receive direction on how to proceed. The licensing specialist must keep the licensing manager/licensing supervisor fully aware of details as they become known so the decision to revoke can be made as quickly as is warranted. The BECR director (or a licensing manager/licensing supervisor acting as the BECR director’s designee) and the licensing manager/licensing supervisor must approve all revocations. The licensing manager/licensing supervisor may alert the OLC attorney when assessing the facts of the situation and determining whether to proceed to revocation.
