1.4 Authority to Revoke a License for Wisconsin Shares Termination

Under the authority of Wis. Stat. § 49.155, in an effort to ensure program integrity in the Wisconsin Shares Program, the DCF Bureau of Child Care Subsidy Administration (BCCSA) is responsible to monitoring the administration of child care subsidy funds. When BCCSA determines that a licensee has provided false, misleading and/or irregular information to the Wisconsin Shares Program, BCCSA may issue to the licensed provider a Notice of Payment Refusal and Revoking of Child Care Authorizations within the Wisconsin Shares Program. This notice terminates the center’s participation in the Wisconsin Shares Program, based on a finding by BCCSA that the licensee failed to comply with the statutes, administrative rules and policies of the Wisconsin Shares Program. For example, the licensee may have falsified records regarding children in care or failed to maintain and submit required accurate attendance records. All terminated providers have the right to appeal their termination from the Wisconsin Shares Program to the Division of Hearings and Appeals within 30 days of the effective date of the termination.

Upon review of the information and findings of BCCSA, BECR will in turn revoke a group or family child care license or day camp license, based on violations of Wis. Stat. § 48, and/or the applicable Wis. Admin. Code. Under the authority of Wis. Stat. § 48.715(4)(b) and Wis. Admin. Code §§ DCF 250.11(8)(a)7., 250.11(8)(b), 251.11(7)(a)7, 251.11(7)(b), 252.05(7)(a)7 and 252.05(7)(b), BECR may revoke a group or family child care license or day camp license if the licensee or any other person under the supervision of the licensee has violated any provision of the administrative rule or Wis. Stat. § 48, or fails to meet the minimum requirements of the rule. BECR may also base the revocation on a determination that the licensee’s actions related to participation in the Wisconsin Shares Program indicate the licensee is not fit and qualified.
