4.3 No Appeal Rights for Violations on the DCF-294A

A public school program is not entitled to file an appeal with DHA to contest the violations identified on a DCF-294A. Programs may, however, contest a certain violation or express displeasure about being cited to the licensing specialist or the licensing manager/licensing supervisor.

The licensing specialist should listen to and consider the program staff person’s opinion with an open mind. It is possible that evidence or documentation will be offered that will result in the licensing specialist rescinding the violation. Sometimes it may be necessary for the licensing specialist to refer an unhappy staff person to the licensing manager/licensing supervisor for resolution. On very rare occasions, the licensing manager/licensing supervisor may decide to rescind a violation after consulting with the licensing specialist.
