2.1 Notice of Temporary Suspension of a License

After receiving the authority to proceed with the temporary suspension of a license from the licensing manager/licensing supervisor, the licensing specialist creates a draft of the suspension notice utilizing the standardized format, Temporary Suspension of License, available on the BECR Intranet.

The standardized format for the temporary license suspension contains the statutorily required notice language; however, the unique case detail must be added. It is critical that the reason for the temporary license suspension is clearly articulated, that all relevant statute and/or rule cites are identified and that all facts related to the violation are accurately and concisely documented, including dates, times and locations. The specific circumstances that require temporary suspension of the license should be described only once. A CFS-294, Noncompliance Statement and Correction Plan, identifying the noncompliance that prompted the license suspension is attached to the notice. It is important to keep in mind that should this enforcement action be appealed, the written notice will become an important reference document in preparing for the administrative hearing.

If the reason for a temporary license suspension is related to the background check law (e.g., the facility will be closed for two weeks while a barred household member finds a new residence), the notice must include the standardized language indicating the requirements for departmental rehabilitation review approval.

The licensing manager/licensing supervisor is responsible for ensuring that the notice of temporary suspension of the license is properly drafted. The original is then sent regular and certified mail or hand-delivered to the licensee (See 3. Delivering the Notice of Temporary Suspension of the License.). As soon as the notice is finalized and delivered, the licensing specialist enters the enforcement into WISCCRS.
