Child Care Licensing Procedure Manual
In response to a contested enforcement action, and with the consent of the licensing manager/licensing supervisor, OLC may negotiate a settlement agreement with the licensee to modify all or a portion of the contents of the enforcement action. This type of stipulation is referred to as a stipulated settlement agreement. Some examples would be an agreement to reduce the forfeiture amount from an original assessed amount, or to remove one or more directives included in an Order to Correct. These agreements do not necessarily place a condition on the license but, rather, specify the understanding by all parties that the contents of the enforcement action itself have been amended.
Usually there are no posting requirements included in a stipulated settlement agreement. Unless the stipulated settlement agreement specifically states that the stipulation must be posted, these stipulations are not considered conditions of licensure, are not identified on the license certificate and are not posted beside the license. If the stipulated settlement agreement specifically includes posting requirements, the procedures described above for stipulations following enforcement action should be followed.
