BECR has 72 hours in which to determine whether to allow the facility to reopen or to proceed to revocation. Occasionally, the circumstances are such that the facility is allowed to reopen within the 72 hours. If BECR will revoke the license, however, a Notice of Revocation must be prepared within the first 72 hours following the summary suspension. The revocation can be amended later, when additional information is made available. In some instances, these two actions may be taken concurrently.
The licensing manager should consult with the BECR director and the OLC attorney when assessing whether a facility’s license should be revoked. The BECR director, or a licensing manager acting as the BECR director’s designee, must authorize the decision to initiate revocation. The OLC must be notified of the revocation following the summary suspension as soon as it is initiated.
