9. Confidentiality of Investigation Findings

All open records requests regarding a complaint must be referred to the DCF Office of Legal Counsel.

Generally, complaint investigation documents are public records, except that references identifying children are confidential and must be redacted from the investigation record prior to allowing access by any non-regulatory persons or agencies not involved in the investigation. Photographs of children must be redacted to protect confidentiality. The identity of children is confidential information for anyone other than the Department, the parent or guardian or another authorized public or private agency. DCF may only refuse to release other information from the record in the unusual situation where disclosure would harm, more than benefit, the public interest.
