2.5 - Denial Related to Violations of DCF 202

Initial certification can only be issued after the applicant has demonstrated compliance with all certification standards (for initial and relocation applications). If an applicant / site does not meet the standards listed in DCF 202 a denial may be warranted.

Under DCF 202.06(5), the certification agency may refuse to accept a new application for 2 years after the date of a denial, revocation, or refusal to renew the certification. The agency’s discretionary authority or administrative determination is appealable under Stats. 68.01 (Milwaukee certification ch. 227).

See Section 2.6 regarding denial notice and Section 10 regarding appeals.

A Noncompliance Statement (DCF-F-CFS294) is not issued when denying an application for certification, recertification or relocation. See guidance on the Certification SharePoint site regarding documenting certification compliance / noncompliance.
