Child Care Certification Policy Manual
The certification worker shall prepare and send written notice of a denial to the applicant. The notice shall provide the grounds for the denial and explanation of the process for appealing the action. It is important the denial notice:
Clearly articulate the reason(s) for the denial.
Identify all relevant statute and/or rule citations.
Accurately and concisely document facts related to the noncompliance(s).
Include information regarding the applicant’s right to appeal.

Denials, even those due to the background check law, are subject to appeal through an administrative hearing. It is important to keep in mind that should the denial be appealed, the notice of denial will become an important reference document in preparing for the administrative hearing. See Section 10 of this module regarding appeals.
When issuing a sanction/enforcement letter (denial, suspension or revocation), it is critical that the certification worker modify the applicant decision / operator category status accordingly and update the enforcement in WISCCRS.
