10.3 - Certification Appeals Process

In accordance with DCF 202.06(6) if a county or tribal agency denies, suspends, revokes or refuses to renew a certification, the agency shall notify the child care operator in writing and give the reasons for the action. The action is reviewable pursuant to ch. 68, Stats., which provides for administrative review of the decisions of local agencies. Tribal agencies shall use an appeal process equivalent to the process in ch. 68, Stats.

 

Wis. Stat. Chapter 68 states, in part, that any person having a substantial interest which is adversely affected by an administrative determination of a governing body or municipality or agent acting on behalf of a municipality may have such a determination reviewed as provided by this chapter. Therefore, an individual should be afforded a fair and orderly administrative procedure and review of any determinations (i.e. penalty or sanction) by the certification agency.
