10.3.3 - Judicial Review

Either party to a proceeding resulting in a final determination may seek a judicial review within 30 days of receipt of the final determination.

 

s. 68.13 Judicial review.

(1) Any party to a proceeding resulting in a final determination may seek review thereof by certiorari within 30 days of receipt of the final determination. The court may affirm or reverse the final determination, or remand to the decision maker for further proceedings consistent with the court’s decision.

 

Note: The procedure for commencing an action by certiorari (judicial review) is found in s. 801.02(5) of the Wisconsin Statutes. If the certification agency or applicant / operator has any further questions about the procedure, the applicant / operator should consult with an attorney and the certification agency should consult with its own corporate counsel.

 

See s. 68.13 for additional requirements for a review of a final determination and s. 68.14 for a legislative review by a governing body. Certification workers shall consult with their agency’s corporation counsel regarding judicial reviews.
