3.4 - Identifying Specific Administrative Rule(s) Potentially Violated

The certification worker determines that a complaint/incident involves a potential violation of certification administrative rules based on the information provided by the complainant (or self-report). In addition to violation(s) of certification rule(s) directly alleged in the complaint, the certification worker must also consider whether other violations exist related to the facts of the complaint/incident. For example, a complaint/incident concerning an injury to a child on the playground equipment should prompt the certification worker to also consider rule violations related to supervision, outdoor hazards, and so on. As the investigation progresses, additional violations may be cited as additional information is gathered. The potential violation(s) identified by the certification worker determines the focus for the complaint/incident investigation. Careful consideration of all possible violations also enables the certification worker to assess the risk posed to the children in care. This risk assessment determines the urgency with which the certification worker should respond to the situation (see sections 3.1. and 4.).
