11.1 - When Not to Issue a Compliance Statement

A Compliance Statement shall not be issued when the visit is due to:

A Compliance Statement indicates that no violations were noted and that some level or degree of monitoring for compliance occurred during the visit. If the purpose of a visit is to conduct an initial or relocation visit, a Compliance Statement is not issued. Because a certification shall not be granted until all certification standards are met, issuance of the certificate of approval indicates the operator has met all certification standards. If the purpose of a visit is to provide technical assistance and no other monitoring for compliance occurred, the certifier should not issue a Compliance Statement.

 

If the purpose of the visit was to investigate a complaint that does not result in a violation or was one in a series of visits related to the complaint, a Compliance Statement is not issued. The same is true if the allegations in the complaint were not substantiated. The certifier may write a complaint summary letter that communicates the allegations were not substantiated, but a Compliance Statement is not issued.

 

Sometimes a certification worker may conduct a visit where the only purpose is to verify previous violations. In these cases, the Noncompliance Statement previously issued should be used to indicate the violations were corrected. A Compliance Statement is not left because or unless no new monitoring occurred.
