15.7.2.1 Determination that Good Cause Exists

If the W-2 agency determines that an individual has good cause for failing to cooperate with efforts directed at establishing paternity and obtaining child support payments, the W-2 agency must promptly:

1.             Notify the individual of the good cause determination and the basis for the determination in writing; and

2.             Notify the CSA of the:

a.      Good cause reason (see 15.6.2); and

b.      Individual’s desire for CSA to suspend case activities or proceed with case activities without the individual’s cooperation.

15.7.2.2 Determination that Good Cause Does Not Exist

If the W-2 agency determines that an individual does not have good cause for failing to cooperate with efforts directed at establishing paternity and obtaining child support payments, and there is no exemption for noncooperation (see 15.5.1), the individual is not eligible for W-2. Prior to imposing cooperation requirements, the agency must give the individual 10 calendar days to either:

1.             Request their case be closed or their application be withdrawn;

2.             Withdraw their good cause claim and begin cooperating; or

3.             Request a Fact Finding Review of the agency’s decision. (See 15.8.1)

If the individual takes no action after 10 calendar days, the W-2 agency must update the Child Support Information section of the CWW Absent Parent page, which will deny or close W-2. (See 15.4.1)
