Each W-2 agency must have at least one individual assigned to conduct Fact Finding Reviews. The Fact Finder must:
Be an individual other than the one who took action on the case;
Be neutral and provide an objective Review and decision regarding the dispute; and
Have a full and complete understanding of all impacted programs.
The Fact Finder will create an environment that is mutually respectful for all involved in the Fact Finding. If the Fact Finder has given a good faith effort in running an equitable Review for participants and staff, but cannot continue due to an individual’s behavior, they may adjourn or exclude participation to complete the review.
W-2 agencies may choose to establish a process with another W-2 agency to assist in providing thorough and objective Fact Finding Reviews.
