9.1.1 Communications with the Complainant

When some or all of the complaint allegations are related to rules identified in the Annual Health and Safety Rule Tag, the licensing specialist can inform the complainant that BECR licensing staff will conduct a follow up investigation regarding those allegations. The follow-up investigation into these potential rule violations is conducted according to the same procedures as an investigation of a complaint alleging violations in a licensed program.

For those rules that are outside of BECR’s jurisdiction, the licensing specialist should advise the complainant of the following:

BECR regional office staff may choose to send a follow-up email to the complainant to explain why a referral has been made to the public school program contact person and/or school district representative, using the following language:

Thank you for contacting the Bureau of Early Care Regulation with your concern regarding <Name of Public School Program>. We have referred your complaint to <Name of Public School Program or School District>. They have responsibility for investigating the complaint allegations that you have reported. Pursuant to Wis. Stat. § 120.13(14), a child care program established and provided by a school board must comply with the applicable standards governing the operation of licensed child care centers in Wisconsin, as provided under Wis. Admin. Code § DCF 251.  <Name of Public School Program or School District> is required to meet all applicable child care licensing standards.
