8.4 Repeat Violations Defined

A repeat violation is a violation that is cited more than once within a two-year period beginning from the date it was first cited. The exact same citation number must be cited for it to be considered repeat. This would include a violation cited on a DCF-294A that remains uncorrected at the next on-site annual visit. It also includes any violation that was cited on a DCF-294A and subsequently corrected, but is again found to be in violation at a monitoring visit within the two-year look back period. This would include the citing of the same violation although the specific circumstances are somewhat different.

Should the exact same citation number be cited more than two years from the date when it was previously cited, the violation is treated as a new violation rather than a repeat violation.

When violations are entered in WISCCRS, the system automatically identifies violations that have been cited within the previous 24-month period. When there is a violation that has been previously cited within 24 months of the visit date, an informational alert will display indicating repeat violation. If the violation is a repeat violation, the form will display the date it was previously cited. (Note that WISCCRS also identifies when a cited violation is ‘serious’, as defined by BECR’s Serious Violations listing.)

(Note: If the form is completed in Word, the repeat violation should be identified as “Repeat Violation” by the licensing specialist, with the date(s) it was previously cited noted in the Rule/Statute Number - Noncompliance Statement column. The notation of previously cited repeat violations should only be those violations repeated within the previous two-year period. For example, the repeat violation would be identified as “Repeat Violation: Previously cited 1/2/2018, 1/12/2018”.)
