BECR does not have statutory authority to initiate enforcement action to compel a public school program to comply with the health and safety rules under BECR’s review. However, in extremely serious situations or when violations remain uncorrected despite efforts to emphasize the importance of needed correction, it may be necessary to refer the public school program to the Child Care Subsidy and Technical Assistance Line for an evaluation of whether Wisconsin Shares funding eligibility should be continued.
Pursuant to Wis. Stat. § 201.04 (5)(cr), if the provider has been given notice that the provider is in violation of applicable licensing or certification rules under Wis. Admin. Code §§ DCF 202, 250, 251 or 252 and the violations have not been corrected by the provider, the department may refuse to issue new Wisconsin Shares authorizations, revoke existing Wisconsin Shares authorizations, or refuse to issue Wisconsin Shares payments until the provider has corrected the violation and demonstrated sufficient controls to ensure that the violation or comparable violations are unlikely to occur again.
When the licensing manager/licensing supervisor determines that the public school program is substantially out of compliance with rules included in the Annual Health and Safety Rule Tag and all other efforts for achieving compliance have been exhausted, s/he may refer the public school program to the Child Care Subsidy and Technical Assistance Line. The BECR director and an attorney from the Office of Legal Counsel must be consulted when making such a decision. The action might include temporary suspension or termination of Wisconsin Shares participation. The referral is made either by email to childcare@wisconsin.gov or by telephone at 608.422.7200. Staff from the Child Care Subsidy and Technical Assistance Line, located in the Bureau of Child Care Subsidy Administration (BCCSA), will determine what further action related to Wisconsin Shares participation is warranted.
