5.4 Choosing the Administrative Rule Numbers

Only administrative rule violations are cited on the DCF-294A. If the licensing specialist determines that the program is not complying with other statutory requirements or new child care statutory requirements, the licensing specialist does not cite the statute.  Rather, the licensing specialist cites the specific administrative rule requirement that compels the program to comply with all laws governing the facility and its operations (summarized as “Compliance with all Laws”). In the description of the violation, the licensing specialist describes how the program is out of compliance with applicable statute. (This situation can happen when there is a delay between the time a new or revised statutory provision is passed into law and the revised administrative rule is approved to implement the new requirements.)

Administrative rules are enumerated from most generic to most specific. For example, Wis. Admin. Code § DCF 251 can be specified as follows: Wis. Admin. Code § DCF 251.06 (most general) or Wis. Admin. Code § DCF 251.06(12) or Wis. Admin. Code § DCF 251.06(12)(c); or Wis. Admin. Code § DCF 251.06(12)(c)3 (more specific) or Wis. Admin. Code § DCF 251.06(12)(c)3.a.(most specific).

The licensing specialist identifies a specific administrative rule violation at the level of specificity which most precisely describes that violation.
