Child Care Licensing Procedure Manual
The conditions of the temporary closure are spelled out in the agreement, as follows:
The licensee must understand that s/he may not operate the center or accept any child for care until further notice from BECR.
The licensee must understand that BECR will continue to conduct required caregiver background checks during the temporary closure.
The licensee must understand that the center remains closed until, upon conclusion of investigation or resolution of other concerns, BECR gives the licensee notice to either reopen the center with or without conditions, or that BECR may revoke the license.
The licensee must understand that BECR will inform the county/tribal subsidy unit of the closure so that authorizations will be suspended.
The licensee must acknowledge that BECR’s burden of proof has been met (usually because of a current ongoing investigation).
The licensee must understand that if BECR revokes the license based upon the investigation findings, appeal rights will be provided at that time.
If BECR issues a revocation, the licensee must understand that the center must remain closed throughout any revocation proceedings that may transpire and until a decision is reached by the Division of Hearings and Appeals (DHA).
The licensee must understand if the DHA rules in the licensee’s favor, the licensee will be given written notice as to when the center may reopen unconditionally or reopen the center with conditions.
The licensee understands that BECR may take such enforcement action as warranted by circumstances not known at the time the temporary closure agreement is executed.
