3.2 Meeting with the Licensee

Once the decision has been made to permit the licensee to temporarily close rather than to issue a summary suspension, the licensing specialist and, if appropriate, with the licensing manager/licensing supervisor, must discuss the situation with the licensee and explain what the temporary closure agreement entails.

The licensing specialist should explain the agreement to the licensee, emphasizing that the licensee is agreeing to keep the center closed until further notice from BECR. The licensee should be told that BECR will determine if the center can reopen and that depending on the results of the investigation, it will also remain closed during revocation proceedings. It should be stressed that all conditions of the agreement must be met by the licensee, or BECR will issue a summary suspension. Each condition included in the agreement should be reviewed with the licensee. It should also be emphasized that by signing the voluntary closure agreement, the licensee is waiving his or her right to request an administrative hearing under Wis. Stat. § 227.51(3) and Wis. Admin. Code §§ DCF 250.11(10)(a), DCF 251.11(9)(a), and DCF 252.05(6)(a) (whichever administrative code provision is applicable) on the matter of reopening the center. Licensees should not be coerced to sign the temporary closure agreement.

If the licensee agrees, the completed “Temporary Closure of Child Care Center Pending Investigation” standardized format is presented to the licensee for his or her signature. BECR’s standardized format that is used for a temporary closure pending investigation, is located on the BECR Intranet.
