Child Care Licensing Procedure Manual
As an alternative to temporarily closing a center, regional BECR staff may make a discretionary decision to allow the center to remain open if the licensee agrees that:
The person being investigated will not be permitted on the premises at any time that children are present or such other times as are necessary to protect the public health, safety, or welfare, or
The person will not work in a caregiver capacity or have other direct contact with children at the center
In making the decision to allow a center to remain open during investigation of the licensee or a staff member, relevant considerations include:
Can children be kept safe if the center is allowed to remain open, but the presence or activities of the person under investigation are restricted?
Can the center operate safely and consistently with applicable rules if the center is allowed to remain open, but the presence or activities of the person under investigation are restricted?
To ensure safety of children and safe operation of the center, is it necessary to restrict the presence of the person from the center during hours when children are present, or would it be sufficient to restrict the person to non-caregiver work (kitchen, maintenance, office) having no direct contact with children?
Can the licensee/director/other responsible person be relied upon to comply with the restrictions imposed?
Size of the center?
Physical layout of the center?
Other staffing at the center?
