It is the responsibility of the licensing specialist to monitor the due date given to the licensee for the return of the correction plan to insure that the plan is received timely. In most cases, the maximum time frame allowed should be 14 calendar days from the date the licensee receives the CFS-294. If the correction plan is not received by the due date, the licensing specialist should contact the licensee by telephone, letter, or email to alert the licensee that the correction plan is overdue and determine the reason why.
When the correction plan is overdue, the licensing specialist must discuss the need for and type of action that should be taken with the licensing manager/supervisor before proceeding with further action. An appropriate response may be to cite the violation, or to:
Grant a reasonable extension of the correction plan if the licensee has a compelling reason for not meeting the deadline, or
Impose a plan of correction under the authority of Wis. Stat. § 48.715(2)(e), deliver a warning letter or take other enforcement action authorized under Wis. Stat. § 48.715.
The licensing specialist does not use the CFS-294 to order a plan of correction. An ordered plan of correction is a sanction authorized under Wis. Stat. § 48.715(2)(e) and is required through a Notice of Order, Sanctions and Appeal Process.
