The following are some examples of rules marked met or unmet without direct observation by the licensing specialist on the day of the visit:
The licensing specialist reviews all 16 reporting rules under Wis. Admin. Code § DCF 251.04(3) with the provider during a monitoring visit. The provider has submitted correction plans timely under Wis. Admin. Code § DCF 251.04(3)(f) and this is marked met. There have been no other reports required of the provider during the current 2-year licensing period. The licensing specialist reminds the licensee of the requirements for submitting other types of reports and based on this discussion and the licensee’s clear understanding of the reporting requirements, the licensing specialist determines that the monitoring results for the remaining reporting rules can then be marked met.
While monitoring rules pertaining to diapering and toileting, the licensing specialist observes that there are no enrolled children using cloth diapers on the day of the licensing visit. The cloth diapering rules were therefore not observed to be out of compliance. The licensing specialist discusses the rule requirements for cloth diapering and if desired, the licensing specialist enters an internal comment to indicate that there are no enrolled infants using cloth diapers. The rules specific to cloth diapering practices would be marked as met.
During a previous visit, the licensing specialist cited Wis. Admin. Code § DCF 251.09(4)(a)6. – Soiled Cloth Diapers – Parent Supplied. At the verification visit, the licensing specialist observes that there are no longer any children currently enrolled that are using parent-supplied cloth diapers. Similar to the example above, the rule is verified corrected as long as no violations were observed and no enrolled children are using parent-supplied cloth diapers. If desired, the licensing specialist may enter an internal comment to indicate there are no infants enrolled using parent-supplied cloth diapers.
The licensee indicates to the licensing specialist that the injuries that occur at the center have been very minor so staff have been instructed that there is no need to document minor injuries in the log book. The licensing specialist provides technical assistance on what must be recorded in the medical log book and marks the rule unmet.
The licensee provides night care and during a discussion with the licensing specialist, she is unable to articulate the night-time program requirements for children in care, leading the licensing specialist to conclude that these requirements are not being met. The licensing specialist provides technical assistance on what is required of the provider and marks the rule unmet.
The licensee takes the children in care to the neighborhood pool and when questioned, indicates that she takes the children there by herself, reasoning that a lifeguard is always on duty at the pool. Based on the number of children in care, the licensee is not meeting the required staff to child ratio for children at the pool. The licensing specialist marks the rule unmet and provides technical assistance on the required staff to child ratios.
