2.3.1 When More Than Two Years has Passed Between Cites for the Same Violations

Should the same violation be cited again more than two years from the date when it was previously cited, the violation is treated as a new violation rather than a repeat violation. Although the licensing specialist would not necessarily move directly to an enforcement action based on the past violation, s/he can issue a warning letter with the Noncompliance Statement and Correction Plan and note the date that the violation was previously cited.
