8.2 Allowing a Facility to Reopen after Issuing a Notice of Revocation

Occasionally information received following delivery of a Notice of Revocation may indicate that revocation is not required. For example, a child abuse investigation may substantiate that it was a parent who inflicted the abuse believed to have been inflicted by a licensee and the licensee is exonerated. In such a situation, since the licensee is completely exonerated, the facility will be allowed to reopen. Notice to the center should be provided verbally and in a follow up letter. The Notice to Permit Reopening of Center may be used to inform the licensee that the summary suspension (or temporary closure agreement) has been withdrawn.
