Child Care Licensing Procedure Manual
The standardized format for executing an agreement to require that a person being investigated will not be present or will work in non-caregiver jobs is located on the BECR Intranet and is titled Agreement to Restrict an Individual's Access to Children in Care-Pending Investigation. It spells out the following conditions:
The licensee must understand that s/he may continue to remain open as long as the licensee either prohibits the person being investigated from being on the premises or from working in a caregiver capacity or having other direct contact with children in care.
The licensee must acknowledge that BECR’s burden of proof has been met (usually simply because of a current ongoing investigation).
The licensee must understand that BECR may take additional action based upon the investigation findings.
The licensee understands that BECR may take such enforcement action as warranted by circumstances not known at the time the temporary closure agreement is executed.
The Agreement to Restrict an Individual’s Access to Children in Care is signed by the licensing specialist and the licensee, but is not posted at the center.
