7. Temporary Closure Agreement in Lieu of Summary Suspension

When a condition exists that necessitates immediate closure of a center, the licensing specialist should consult with the licensing manager/licensing supervisor on whether the licensee should be given the option to sign a temporary closure agreement in lieu of receiving a summary suspension. Under such an agreement, BECR will specify that  the licensee immediately close the child care center with conditions and until an investigation is completed. The temporary closure agreement suspends the center license and assures that no children are in care until the conclusion of the investigation and probable revocation proceedings or until the Department allows the center to reopen. If the licensee voluntarily agrees to sign the temporary closure agreement, the Notice of Summary Suspension is not issued. It is also not necessary to conduct the summary suspension hearing within 72 hours to determine whether the center may reopen.
