6.1 Waiver of Hearing for Summary Suspension

The licensee may agree to sign the Waiver of Hearing for Summary Suspension – Temporary Closure of Child Care Center , which states that the licensee agrees to waive the required hearing scheduled by DHA on the issue of whether the license must remain suspended during revocation proceedings. The licensing specialist should explain the agreement to the licensee, emphasizing that if the  licensee signs the agreement, s/he will not participate in an automatic hearing to determine whether the center may reopen during revocation proceedings, and the center must be kept closed until further notice from the Department. The agreement further states that the licensee understands that his/her license to operate is suspended and that BECR will provide a notice to either reopen the center with conditions or revoke the license. It also indicates that if the Department elects to revoke the license based upon the investigation findings, information will be provided on how to appeal that decision. The center also agrees to remain closed throughout any revocation proceedings that may transpire and until a decision is reached by the DHA.
