Typically, a copy of the Notice of Summary Suspension is hand-delivered to the licensee, although the statute permits a verbal summary suspension (by phone or in person). A written notice should be sent following a verbal notice.
At the discretion of the licensing staff, the licensing manager/licensing supervisor or another specialist may accompany the licensing specialist to the facility to deliver the summary suspension. In some situations, it is advisable to request the assistance of law enforcement. The licensing specialist must document the date, time and persons involved in the delivery. If possible, it is advisable to have the licensee sign a Delivery of Document Receipt. A standardized format for this receipt is available on the BECR Intranet. All delivery/receipt documentation must be included in the facility file.
Licensing staff should inform the licensee that the Notice of Summary Suspension must be displayed beside their license in accordance with Wis. Stat. § 48.657(2g) and Wis. Admin. Code § DCF 250.04(2)(i), 251.04(2)(L) and 252.41(1)(L) until such time as the suspension is lifted or the revocation takes effect.
