2.1 Notice of Summary Suspension

After receiving the authority to proceed with the summary suspension from the licensing manager, the licensing specialist creates a draft of the Notice of Summary Suspension. The draft is developed utilizing the standardized format available on the BECR Intranet.

The standardized format contains the statutorily required notice language; however, the unique case detail must be added. It is critical that the reason for the summary suspension is clearly articulated, that all facts related to the violation are accurately and concisely documented, including dates, times and locations and that appropriate statute and/or rule cites are included. It is important to keep in mind that the administrative hearing to determine whether the facility can reopen after 72 hours, pending the conclusion of the revocation process, will be based on the facts as stated in the Notice of Summary Suspension.

The licensing manager is responsible for ensuring that the Notice of Summary Suspension is properly drafted and may have it reviewed by the BECR director and/or the OLC attorney before signing the final document. The original is then typically hand-delivered to the licensee.
