It is possible that a stipulation must be executed to require immediate correction of one or more violations, even while the licensing specialist continues an ongoing investigation to determine whether additional violations will be cited or enforcement action will be imposed. For example, the licensing specialist may determine that the center’s method of tracking attendance must be immediately corrected and the licensee must sign a stipulation agreeing to such, but the licensing specialist has not yet determined whether there are other violations related to supervision and record keeping that will also need to be addressed.
In these situations, the stipulation should include a clause that states the following:
The licensee understands that the Department is still conducting an investigation regarding additional violations that may have occurred on (specified) date. Such potential violations include, but are not limited to, (specified) violations. The licensee understands that the stipulation only resolves violations of the specified rules and that additional action may be taken at the completion of the Department’s investigation if additional rule violations are determined. The Department will provide notice to the licensee when the investigation is completed and will address any enforcement actions at that time for additional rule violations, which may include Orders, Forfeitures, Denial or Revocation.
