Each stipulation drafted by BECR includes the following contractual clauses:
The agreement, requires the licensee to post the stipulation with the license from the Department, in a location where parents can see it during the hours of operation. (Note: Stipulated settlement agreements may not include this posting requirement.)
That it is expressly agreed that in the event that the applicant/licensee fails to comply with any of the terms of the stipulation, that the Department may take appropriate enforcement actions under the provisions of Wis. Admin. Code § DCF 250.11(8) / 251.11(7) / 252.05(7) and Wis. Stat. § 48.715, including license denial or revocation, order or forfeiture to obtain compliance with the agreement.
That the stipulation is effective only if the applicant/licensee returns an executed copy to the Department within a specified number of days (defined in the stipulation) from the receipt of the stipulation by the applicant/licensee.
