8. Using the Standardized Formats for Stipulations

The following procedural guidelines relate to stipulations drafted by the BECR licensing specialist and licensing manager/licensing supervisor with assistance of the OLC attorney. Although stipulations negotiated by the OLC attorney to resolve an appealed enforcement and other types of compliance issues may include the same or similar language as the stipulations drafted by BECR, OLC staff have the discretion to amend the stipulation language as needed.

After receiving the licensing manager/licensing supervisor’s approval to proceed with a stipulation to a license, the licensing specialist prepares the draft using one of two standardized formats, titled Stipulation, and License with Conditions Stipulation – Family Child Care/Foster Home. Both are found on BECR Intranet.

The standardized format for the stipulation contains required language; however, the unique conditions to the license must be added. The rationale for the stipulation may be included as well as all relevant statute and/or rule cites. The licensing manager/licensing supervisor may decide that the specific circumstances that necessitated the stipulation should be briefly described once in the body of the stipulation.

The licensing manager/licensing supervisor shares the draft stipulation with the OLC attorney for his/her review and approval to ensure that the stipulation is properly drafted. The original is then either sent certified, regular or electronic mail or hand delivered to the licensee. The specified number of days allowed for return of a signed stipulation usually does not exceed 10 days, and may be as few as three days. However, the standard format, Stipulation and License with Conditions Stipulation – Family Child Care/Foster Home, provides a 30-day time frame for returning the agreement.

Once the signed stipulation is returned by the licensee and then signed by the licensing manager/licensing supervisor, the licensing specialist enters the stipulation in WISCCRS, according to the guidelines set forth for each type of stipulation. The stipulation is uploaded into the document repository in the Application Details section or the document repository tied to the specific enforcement action in WISCCRS.
