5.4 Enforcement Identification - Begin and End Dates

A stipulation that settles a contested enforcement action must be entered as a decision to the related enforcement in WISCCRS, in the Enforcement module. This assures that the stipulation which resulted from the enforcement action is identified with the enforcement in WISCCRS and reflected in the Regulation Details section of the public search website. The public website will display the stipulation in the “Decision” column beside the enforcement action that was appealed. The stipulation is uploaded into the document repository tied to the specific enforcement action in WISCCRS.

Because WISCCRS is programmed to display enforcement actions, warning letters and stipulations appearing in the Regulation Details section of the public search website for the previous three years only, an enforcement action will “drop off” the public page three years after the mailing date that it is entered in WISCCRS. This means the begin and end dates are handled somewhat differently for stipulations that will be displayed in the Regulation Details section of the public website.

The begin date for a stipulation entered in the Enforcement decision field in WISCCRS (and displayed in the Regulation Details section of the public search website) is the mailing date of the stipulation. The mailing date is also entered for the decision date and the closed date. Entry of the mailing date for both the decision date and the closed date will prevent the stipulation from appearing on the active enforcement report.

Stipulations negotiated to settle an appealed enforcement action often remain in effect beyond the three-year posting period provided for in the Regulation Details section of the public website. In fact, such a stipulation may be in place as long as the center remains open. If an end date is not entered in the Conditions section in WISCCRS, the stipulation will display on the license certificate until the end of the licensing period. It must be re-entered at license continuation in the new Application Conditions section. (See 5.3 Condition Details - Begin and End Dates.)
