Child Care Licensing Procedure Manual
Following an appeal of an enforcement action by an applicant or licensee, a stipulation may be negotiated that rescinds the enforcement action and set forth requirements to address and remediate the compliance issues highlighted in the enforcement. These stipulations are drafted by the Office of Legal Counsel and represent an agreement reached between all parties (BECR, the applicant/licensee, OLC, and the licensee’s legal representative) to settle the contested enforcement action through conditions for licensure, as set forth in the stipulation. Thus, the applicant/licensee agrees to specific licensing conditions that will ensure compliance with licensing statute and/or rule and, if appropriate, certain additional directives required by BECR.
An example of this type of stipulation is a stipulation that is drawn up following a denial of a license due to the presence of a household member with a conviction that prohibits licensure of the facility. The licensee states that the household member has since moved from the premises and can produce evidence that the barred person is residing elsewhere. The stipulation rescinds the denial and sets forth conditions that clearly prohibit the household member from returning to the premises while the center is licensed and states that the license will be revoked if the licensee does not abide by the stipulation conditions.
