4.5 Exception as a Condition of Licensure

An exception to the administrative rule, like a stipulation, is a condition of licensure. However, an exception is initiated by the licensee, rather than the licensing specialist, and granted by the licensing specialist if certain criteria are met. An example is a BECR-approved exception permitting a multi-site child care agency to store staff records at a central location.

An exception to the administrative rule may only be granted by BECR if the licensee can demonstrate to the satisfaction of BECR that the exception will not jeopardize the health, safety, or welfare of any child served by the center. The request for an exception is made in writing to the BECR regional office and justifies the requested action and describes the alternative provision that will assure that the intent of the rule requirement will still be met.

Like a stipulation, an exception granted by BECR must be posted next to the license in an area visible to parents and the public. It is identified on the license certificate and in the Condition Details section on the Regulated Child Care and YoungStar Public Search website.
