Child Care Licensing Procedure Manual
These stipulations spell out an agreement with BECR that certain conditions will be met in order for BECR to grant a license or continue a license, usually executed instead of issuing an enforcement action.
Examples include the following:
To set additional requirements for licensure relating to the operation of the center, above and beyond the administrative rule - BECR determines that the background and/or personal circumstances of the applicant/licensee may negatively relate to the care of children and/or the activities of the facility. However, BECR also believes that the applicant/licensee is suitable for new or continued licensure as long as s/he adheres to specific conditions, including certain, additional requirements and/or restrictions during those periods of time when children are in care. In this instance, there must be a reasonable expectation that the applicant’s/licensee’s agreement with the stipulation will assure compliance with licensing rule and any other additional conditions required by BECR. A common example of this type of stipulation would be a stipulation that requires a certain household member to remain off premises during child care business hours.
To draw attention to certain portions of the administrative rule - BECR determines that the applicant/licensee has exhibited certain behaviors in the past that, while not strictly prohibiting licensure, will require additional vigilance on the part of the applicant/licensee. A stipulation is executed to draw attention to those portions of the rule to which the licensee must be especially attentive. An example of this type of stipulation would be one that emphasizes rule requirements for behavior guidance with a licensee that has used inappropriate discipline in the past.
To secure an agreement from the licensee that the licensee understands and will comply with BECR-imposed training requirements - The licensee violates one or more administrative rules, demonstrating the licensee’s disregard for and/or lack of understanding of administrative rule provisions. Based on the cited rule violations, particularly in the case of serious and repeat violations, the licensing specialist determines that the licensee and staff will need BECR-approved training in a particular subject area to prevent future violations. The stipulation secures the licensee’s express agreement to participate in the training and avoids more serious enforcement action, such as a revocation. The stipulation is used to compel the licensee and staff to complete training.
