Child Care Licensing Procedure Manual
The following are some examples of the kinds of licensing situations that have been settled through a stipulation:
An applicant has appealed a denial resulting from a background issue and the OLC, BECR and the licensee have reached an agreement to allow the licensee to operate the child care center, but only if a certain household member is not on the premises of the child care center during hours of operation.
The licensee is providing family foster care for one child in addition to operating a child care center, and a stipulation is executed to specify the terms of the arrangement, including the maximum number of foster care children and other children that may be in care.
The background check of a family member returning to live at home with a family child care licensee reveals a criminal history of non-barred crimes or offenses, or abuse or neglect unsubstantiated allegations that give the licensing specialist reasonable concern for the safety of children in care. Rather than revoke the license, a stipulation is executed to prohibit this household member access to the child care premises while children are in care.
A minor child of the licensee has a suspected abuse history that could pose a threat to the health, safety, and welfare of children in care. Because the minor child will be present in the home during family child care business hours, a stipulation is executed to assure that the licensee maintains sight and sound supervision of the minor child at all times while children are in care.
The applicant for licensure has completed rehabilitation review under the Background Check Law and the rehabilitation review panel has specified conditions for rehabilitation approval, such as no further law violations or substantiated findings that are restated in a stipulation.
In response to serious, repeat violations, a stipulation is executed to require the licensee and his/her staff to attend training specified and approved by BECR, such as training in child abuse mandatory reporting requirements, business management skills, safeguards in transporting children, etc.
A stipulation is executed to call the licensee’s attention to the prohibition against the use of any type of inappropriate discipline with children in care. The stipulation restates the child guidance portion of the administrative rule and spells out the consequences to the licensee of violating the stipulation in using inappropriate discipline.
A stipulation is executed to describe extra precautions that must be put in place to address a physical hazard on the property.
